It was late at night when Jade and Jermaine were driving southbound along Capitol Street in Indiana, when they came to a stop at a red light. Jade was at the wheel, and Jermaine was in the passenger seat. As the light flashed green, Jade proceeded through the intersection, and then saw another flashing light out of the corner of her eye – something wasn’t right. Before Jade could turn her head to see what it was, her vehicle was rammed into by an oncoming SUV – one that was going the wrong way down a one-way street.
The cars collided, bashing up both front ends, and leaving Jade and Jermaine in shock and pain. When medics and police arrived, both Jade and Jermaine didn’t think they needed to go to the hospital -perhaps due to the state of the shock they were in, because in reality, Jermaine had been seriously hurt.
As for the other driver, the one who had been driving the wrong way down a one-way street, she was let go without a fine or even a sobriety test.
The next morning, with bandages across his face and one eye patched up, Jermaine woke to blurred vision. Still bloodied and bruised, Jermaine had sustained a broken nose and broken left eye socket, which required reconstructive surgeries.
Weeks would pass before Jade and Jermaine heard back from State Farm, the insurance company of the driver in the SUV. And when they did hear back, they were in for another blow for how they were treated.
By the time they heard from State Farm, the police report had been released, which clearly indicated the driver of the SUV was at fault for driving the wrong way down a one-way street.
And yet, Jade received a letter from State Farm, which stated that they had “carefully investigated the facts and circumstances” and found their driver was not at fault, and not liable for any damages.
Adding insult to injury, Jade was also sued by State Farm! She received a demand letter stating they had to pay $3,000 for the other driver’s damages. Unfortunately, this is a very common occurrence and can devastate drivers who are not aware of their rights.
With all that was being thrown at them by the insurance company, Jermaine and Jade felt threatened, scared, and defeated, and wondered if it was not just easier to pay for the damages they were being sued for and make it all go away.
But as Jermaine continued to struggle with his injuries, something told him that the situation wasn’t right. And he realized that if he was going to fight back, he couldn’t do it alone.

He asked for a response in 24 hours – by which time, if they didn’t reply, Brandon would be filing not one, but two claims in court: one, for Jade and Jermaine’s damages and another with the Indiana Department of Insurance for what appeared to be a clear case of insurance bad faith.
Within less than 24 hours, State Farm replied, ready to cut a check that would adequately compensate Jermaine’s and Jade’s damages from the accident.
